Terms of Service

Effective 2026-11-02 (version 2026-11-02)

Agreement

These Terms of Service ("Terms") are a contract between you and FarmStation Pro, operated by David Collenberg ([LLC NAME]), Fort Jones, California ("FarmStation", "we", "us"). By creating a farm, tapping "I agree", or using the FarmStation Pro app, website or services (the "Service"), you agree to these Terms and to our Privacy Policy. If you use the Service for a business, you agree on behalf of that business. If you do not agree, do not use the Service.

The Service is also subject to Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If these Terms conflict with Apple's EULA, these Terms control to the extent permitted.

Informational use only; not professional advice

The Service, including its AI assistants (Animal Health, Mechanic, Agronomist, Bookkeeper, tracker experts and the Plant Identifier), weather alerts, spray and haying windows, market information, compliance tools and imported or scanned data, is provided for general information only.

Nothing in the Service is professional veterinary, agronomic, crop-advisor, pest-control, mechanical, engineering, legal, tax, accounting, financial, food-safety or regulatory compliance advice, and no professional relationship is created. AI output can be wrong, incomplete or out of date.

You are solely responsible for every decision about your operation, animals, crops, equipment, workers, customers and finances. You agree to: (a) read and follow every pesticide, herbicide, fertilizer, animal-drug and product label and all applicable federal, state and local laws, permits and restrictions (including grazing, haying, pre-harvest and withdrawal intervals); (b) consult a licensed veterinarian, pest control adviser, certified crop adviser, qualified mechanic or dealer, accountant, attorney or certifier as appropriate; (c) call a veterinarian immediately for animal emergencies; and (d) follow manufacturer safety procedures, including shutting down and locking out equipment before servicing.

Your data and its accuracy

You own the records, photos and other content you put into the Service ("Your Content") and you grant us a license to host, process and display it to provide and improve the Service.

Features that read or create data for you, including scale-tag and serial-plate reading, receipt and document import, AI-proposed records, draft invoices and statements, may contain errors. You must review and confirm all such data before relying on it, filing it, or sending it to anyone. You are responsible for the accuracy of invoices, statements, compliance records and anything you share.

Integrations

Connections to third-party services (for example weather stations and imported files from irrigation, scale or farm-management programs) are read-only unless the Service expressly says otherwise. If any future feature can send a command or change to equipment or another service, it will act only after you confirm it, and you use it entirely at your own risk. We are not responsible for third-party services, their data, availability or terms.

Crew and team use

If you invite crew or employees, you are responsible for their access and for what they submit, and for having any consents required to collect their submissions, location and photos.

Subscriptions, trials and auto-renewal

Paid plans purchased in the app are billed by Apple to your Apple ID. Subscriptions renew automatically at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period. Free trials convert to a paid subscription unless cancelled before the trial ends. Manage or cancel in your Apple ID settings (Settings > your name > Subscriptions). Refunds are handled by Apple under its policies.

Plans include AI usage limits that may reset daily or monthly as shown in the app. Features that do not use AI keep working when a limit is reached. Enterprise plans sold directly are governed by these Terms and any order form. We may change prices or features with notice as required by law and Apple's rules.

Acceptable use

Do not misuse the Service: no unlawful use, reverse engineering, scraping, overloading, attempts to bypass usage limits or security, or uploading content you do not have the right to use.

No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT AND UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FARMSTATION AND ITS OWNERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF CROPS, LIVESTOCK, EQUIPMENT, PROFITS, REVENUE, DATA, CERTIFICATION OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR ANY AI OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US (OR APPLE ON OUR BEHALF) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You will defend, indemnify and hold harmless FarmStation and its owners and employees from any claims, damages, losses and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, your operation, your crew, your invoices or records, or your violation of these Terms, any label or any law.

Disputes: binding individual arbitration and class action waiver

Please read this section carefully. You and FarmStation agree to resolve any dispute relating to the Service or these Terms by binding individual arbitration administered by the American Arbitration Association under its Consumer or Commercial Arbitration Rules, as applicable, rather than in court, except that either party may bring an individual claim in small claims court or seek injunctive relief for misuse of intellectual property.

YOU AND FARMSTATION WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION OR REPRESENTATIVE PROCEEDING. Before filing, the party with a claim must send a written notice and try in good faith to resolve it for 30 days. You may opt out of this arbitration section by emailing support@farmstationpro.com within 30 days of first accepting these Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and the Federal Arbitration Act. Subject to the arbitration section, exclusive venue is the state and federal courts located in Siskiyou County, California.

Changes and termination

We may update these Terms. We will post the new version with a new effective date and, for material changes, ask you to accept them in the app. You may stop using the Service at any time. We may suspend or end access for violations. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification and arbitration) survive termination.
